Terms of sale

1. Purpose

These Terms and Conditions of Sale govern all sales of products made on the PLURASTOCK website between PLURASTOCK and any customer placing an order through the website.

2. Products

The essential characteristics of the products are presented on the website. It is the customer’s responsibility to review them before placing any order.

Photographs, visuals, videos, renderings, demonstrations, and illustrations displayed on the website are provided for informational purposes only and are not contractually binding.

Minor differences in color, texture, finish, surface appearance, or presentation may exist between the visuals shown on the website and the delivered product.

3. Territorial Scope – Available Destinations – Excluded Areas

PLURASTOCK offers its products for sale internationally, subject to the legal, regulatory, logistical, customs, security, or commercial restrictions applicable at the time of the order.

PLURASTOCK reserves the right, at any time and without prior notice, to limit, suspend, refuse, or cancel any order:
- destined for a country, territory, or area subject to prohibition, embargo, sanctions, export restrictions, or any other applicable control measure;
- involving any individual, legal entity, organization, intermediary, recipient, or address listed on a sanctions list or subject to freezing, blocking, or restriction measures;
- where there is a reasonable risk of fraud, regulatory non-compliance, customs blockage, non-delivery, logistical insecurity, or violation of any applicable regulation.

PLURASTOCK may also refuse an order where a destination, although not formally prohibited, presents a level of risk considered excessive due to shipping security concerns, unreliable carriers, geopolitical conditions, customs difficulties, local import restrictions, or disproportionate processing costs.

If an order is refused or cancelled for any of the reasons above before shipment, any sums already paid for the order will be refunded to the customer, without any further compensation being due.

It is the customer’s responsibility to ensure, before placing an order, that the importation, possession, use, and potential resale of the product are permitted in the destination country.

4. Prices

Prices displayed on the website are indicated in euros including all applicable taxes, or where applicable, in any other currency offered on the website.

Shipping costs, taxes, customs duties, import charges, or any other fees that may apply are indicated to the customer before the order is confirmed where such amounts are known. Unless expressly stated otherwise, any duties, taxes, and fees payable upon importation into the destination country remain the responsibility of the customer.

PLURASTOCK reserves the right to modify its prices at any time. The applicable price is the one displayed at the time the customer confirms the order.

5. Orders

An order is considered final once payment has been validated and confirmation has been issued by PLURASTOCK.

PLURASTOCK reserves the right to refuse or cancel any order in the event of a prior dispute with the customer, suspected fraud, payment default, obvious pricing or product description error, supply difficulty, logistical impossibility, regulatory non-compliance, or any other legitimate reason.

6. Payment

Payment is made using the payment methods offered on the website at the time of the order.

PLURASTOCK reserves the right to suspend, refuse, or cancel any order in the event of suspected fraud, irregular payment attempt, payment default, or any reasonably necessary additional verification.

7. Delivery

Delivery methods, shipping costs, and estimated delivery times are indicated to the customer before the order is confirmed.

Delivery times are provided for information purposes only, unless expressly stated otherwise.

PLURASTOCK shall not be held liable for any delay, blockage, seizure, return to sender, additional cost, or impossibility of delivery caused by the carrier, customs authorities, logistical disruption beyond its control, force majeure, local regulations, or the customer’s fault, including in the event of an incorrect, incomplete, or unusable address.

8. Right of Withdrawal

Where the law applicable to the contract or any mandatory regulation applicable to the consumer so provides, the consumer customer shall benefit from the corresponding right of withdrawal.

For orders subject to French consumer law, the consumer customer has a withdrawal period of fourteen (14) days from receipt of the product, under the conditions provided by law and detailed in the website’s return and refund policy.

Returned products must be sent back complete, in a condition allowing resale, together with any accessories, instructions, and packaging, subject to the handling necessary to establish the nature, characteristics, and proper functioning of the product, within the limits permitted by law.

9. Legal Warranties, Normal Wear and Tear, Maintenance, and Commercial Warranty

Products sold by PLURASTOCK benefit, where applicable, from the mandatory legal warranties available to the customer under the applicable law.

For sales subject to French consumer law, products notably benefit from the legal warranty of conformity and the legal warranty against hidden defects, under the conditions provided by law. In particular, the consumer has a period of two (2) years from delivery of the goods to act under the legal warranty of conformity.

The seller delivers goods that conform to the contract and is liable for any lack of conformity existing at the time of delivery of the product.

Independently of any legal warranties, PLURASTOCK may, where applicable, offer a commercial warranty. Such commercial warranty is optional and does not replace or reduce the customer’s legal rights in any way.

The customer is expressly informed that certain components or surfaces of the product may, under normal use, show minor aesthetic or mechanical changes that do not affect the essential functionality, normal purpose, or safety of the product.

The following are notably considered to fall within normal use of the product:
- the appearance of marks, traces, micro-scratches, polishing, friction marks, or visual alterations on plastic or surface areas located around magnetic elements, due to repeated handling, contact, magnetic coupling, transport, storage, or repeated use;
- the progressive wear of straps and their components, including textile parts, faux leather, soft coatings, finishes, or contact surfaces, including flaking, visual deterioration, discoloration, softening, loss of appearance, pilling, dirt marks, or other signs of wear;
- the occasional need for limited routine maintenance, including light retightening of certain screws as part of normal use of the product.

Such phenomena, when resulting from normal use, repeated handling, transport, storage, normal conditions of use, or routine maintenance, shall not in themselves constitute a lack of conformity, provided that they do not abnormally affect the essential functionality, normal usability, or safety of the product.

Accordingly, the following are not covered by PLURASTOCK’s commercial warranty:
- normal wear and tear;
- purely aesthetic alterations that do not affect the normal use of the product;
- the progressive wear of straps, coatings, faux leather, contact surfaces, or other replaceable elements subject to friction, tension, compression, perspiration, storage, or repeated handling;
- light maintenance falling within normal upkeep, such as light screw retightening;
- damage resulting from shock, dropping, crushing, excessive pulling, improper storage, improper maintenance, misuse, modification, unauthorized disassembly, unauthorized repair, or any abnormal use of the product.

Straps and other items considered wear parts or replaceable elements may be sold separately for replacement or renewal purposes. Their progressive deterioration resulting from normal use is not covered by the commercial warranty.

However, defects of conformity existing at the time of delivery, as well as hidden defects meeting the legal conditions applicable under the relevant law, remain fully covered.

The request must include a precise description of the issue encountered, useful photographs, and, where necessary, any proof of purchase allowing identification of the relevant order.

PLURASTOCK reserves the right to examine the product, based on photographs or after return, in order to determine whether the request concerns normal wear and tear, routine maintenance, damage resulting from use, or a defect potentially falling under a legal or commercial warranty.

11. Liability

PLURASTOCK shall not be held liable for non-performance or improper performance of the contract in the event of force majeure, logistical disruption beyond its control, unforeseeable and unavoidable acts of a third party, administrative, customs, or regulatory measures, or fault on the part of the customer.

In any event, PLURASTOCK shall not be liable for indirect, intangible, consequential, incidental, or special damages, loss of business, loss of opportunity, or loss of revenue, except where mandatory legal provisions provide otherwise.

12. Personal Data

Personal data collected in connection with orders are processed in accordance with the website’s Privacy Policy.

13. Consumer Mediation

For sales subject to French consumer law, the customer has the right to use a consumer mediator free of charge in order to seek an amicable resolution of any dispute with PLURASTOCK.

After first contacting PLURASTOCK in writing, the customer may refer the matter to the competent consumer mediator, whose details are as follows:

14. Governing Law and Jurisdiction

These Terms and Conditions of Sale are governed by French law.

However, if the customer is a consumer residing in another country, the mandatory consumer protection provisions applicable in that customer’s country of habitual residence shall remain applicable to the extent that they cannot be contractually waived.

In the event of a dispute, jurisdiction shall be attributed to the French courts, subject to any mandatory rules to the contrary applicable to the consumer.
